The invention involves the evaluation unit (5) using the response signal and/or the temporal behaviour of the response signal to determine a statement regarding a batch at the probe unit (3), at least one first formula and one second formula or one first evaluation algorithm and one second evaluation algorithm being stored in the evaluation unit (5), and, in the event of the batch being below a predetermined limit value, the evaluation unit (5) using a first formula to determine the statement regarding the filling level and, in the event of the batch being above the predetermined limit value, the evaluation unit (5) using a second formula to determine the statement regarding the filling level.
